He says he'll call us if he has work for us. Is it right to just send us home? Should he give us a letter stating that there is no work for us?

You'll need to get something in writing from your employer with a contact phone and address of the business when you apply for unemployment.
If he won't do this for you then consider yourself laid off and start looking elsewhere for work.
You still have to put food on the table and pay the bills.

An employer has the legal right to send workers home if there is no work available for them. He must, however, pay for a minimum of 4 hours even if he sends them home after one hour. If it seems that there hasn't been any work for some time, you could request a lay off. He does not need to give any letter stating there is no work. He will have to give a Record of Employment if he lays you off. On it, he will state "Lack of work".
