. This was a year ago. He had said that i would never see the money,because he would work until he was 90!!! The divorce papers say that he is to notify me whenever he starts to draw his part. It also states that I would be able to draw my part at the earliest time that he is eligible to retire. He was eligible to draw after 25 yrs of service at his job. He completed 25 yrs. on the 1st of Sept. '06. Shouldnt I be able to get my part out now??? Just because he has a new girlfriend and baby, and choses to continue to work there, even though he is now eligible to retire, Do i have to wait to get my part? I really need it NOW!!!

You might want to check with any attorney who specializes in divorce and retirement law. It sound like your divorce attorney didn't do the right job.
You should have had the court issue you a qualified domestic relations order that you would present to his company that would have protected you rights to withdraw funds.

Has the QDRO even been served? No service, no receipt of funds. If served and provider does not pay - haul them into court for contempt.

call the custodian or the financial company where he has retirement account ... they will tell ya ... if you need it now, then just take it .....
its all about money
