My best friend was raped 17 yrs ago...by a sick loser.They just finished the trial....the jury recommended 38 yrs( I guess it was the jury that rec it...not really sure)

I personally think he should have rec more...this was a cold case....in fact the oldest hit for a cold case(rape) in my state.

Sentencing is not until DEC.

20 yrs for kidnapping
10 yrs for the rape
3 yrs for sodomy
5 yrs for using a weapon(firearm)

Do you think he will actually get that much time....can the judge lower that amount?

He has been in prison since he was arrested for this case...maybe 1.5 yrs.

I'd be interested to see what happens. Most times the judge sticks to the recommendation, but remember that he will be eligible for parole after serving only 1/3 of the sentence.

I hope your friend has some peace of mind now. That's really horrible. The cold case team should be very proud of themselves.

Interesting matter... That guy must really be a loser, if his lawyer hasn't managed to get some charges thrown out as per statutes of limitations, 15 years after the fact.

depends on the judge, and lots of other factors. The fact that the case is 17 years old should not affect his decision at all. in general, judges like to stay close to jury recommendations unless there are some very unusual circumstances. I'm guessing he gets at least 30 years.

He will serve a good portion of that for the kidnapping and weapon at least, much depends on if he continued his criminal behavior after her rape and if he can convince the judge of his remorse. She may want to appear at his parole hearing when he has them to remind the board how this affected her life. That really seems to help keep them in.

I don't know but he's sick and I think he should be put away for life....without parole. Your friend can attend future parole board meetings and petition that he stay in prison for his entire sentence.
Sorry about your friend but I'm glad she is finally getting justice.

Depends on if they run them consecutively or concurrently Depends also on the state, how much good time they give per year.

Until sentencing actually occurs ,who knows! But he will probably only serve one third of his sentence and double time for time served.
