Especially in places where children are left orphaned because of AIDS, I just read the article about Madonna, and I am wondering why there are these bans, and just how fair is it that these super rich people can bend the rules?

This is an interesting question.

There are several factors that come into play. Firstly there is a regualation of a trade that can result in babies made to order and child abduction. I have read reports of this happening in South Korea which is one of the most popular countries for people in the USA to adopt from.

Secondly there is an ethical issue - should the money involved in the adoption of one child not be used to improve the lives of more than one child in that country rather than remove one. It is not a sustainable solution to the problems facing countries suffering from war, hiv epidemics, poverty and poor governance.

Thirdly, intercultural and inter-racial adoption is not without issues - especially of children who have lived through war, rape or prostitiution - however, on the other hand adoption of children who have lived through trauma is not unproblamatic anyway.
Many organisations and childcare experts believe that it is better for the child to have some form of cultural continuity whereever possible. However, adoption may well be better than being left in a childrens home in a poor country.

I personally don't think adoption of children from poor countries presents a long term sustainable solution to the countries' problelms.

the ban on adoptions in the 3rd world countries are usually because of their religious beliefs....its sad...and super rich can bend the rules with money...and its also good PR for the country at hand
