I'm about 2 months behind in rent, my landlord ask my family to move about 2 weeks ago, i ask for a 30 day notice she told me no, that she wanted me out the apartment in 2 weeks, which would've made the end of last month. Now just last night 9/03/06 around 8:30pm-8:45pm, she approached may husband with a pistol and waved it in his face, he was able to come in the house, but she followed him trying to force her way in. When I got to the door she pointed the gun at us, We call the police, which took 30 min to arrive. They took the report from both neighbors, they claimed they put out a warrant for her arrest, but they can't locate her, I run a in home daycare and during the incident I had 2 small children in my home. What can I do?.

It sounds like you've already filed a police report. I would move out if I were you.

Good thing you called the cops. Not sure where you are from but there is a thing called the landlord and tenent act. Ask around and find out more about it. When you are behind in rent they have to take you to court and there is a long process. Until the sherrif shows up to lock your doors you don't have to go. I know what it's like to be behind in rent. Just give what you can. If it show's you are making an effort (even if it's 50 bucks a week) they really can't do anything. No excuse for the gun though. Holy crap....make sure you get rid of that landlord. Keep pesting the cops until they find her. Good luck and I hope you don't loose your job over this.

Well, first the Landlord was wrong to brandish a gun She could have sought a formal/legal eviction after 30 days. But the next issue is why have you languished on the rent for so long and then insisted on a 30 day notice? How could you be running a day care center in a dwelling you may not occupy tomorrow. What has your husband done to diffuse/ correct/improve you situation? Sure the landlord is erratic and impulsive with her reaction but seeking some type of legal relief or bureaucratic interference is not the solution for a family on the skids!

I would get a restraining order ASAP! Although you are behind on your rent, the children's safety (and yours also) should take precedence. Granted, you are being evicted, but that is no excuse for the gun or any type of violence. Stay on the police, get the restraining order, get the parents of the children to complain to the police. Several people constantly hounding the cops will be more effective than just one person. I would also try to move in the meantime - even if it is in with a friend or family member for the time being. Your land lady sounds like she is a bit disturbed & dangerous!.... Good luck!!

You have called the police and filed a report which is good. You still have to handle the issue of rent. Even though the landlord is crazy and murderous you will still be legally held to pay it.

First try to find a legal aid/legal fund that offers free legal service in your city and speak with a lawyer.

Second get a gone and protect your family.

Next step is to get a lawyer. Get a copy of the police report. Where do you live. In the USA, tenants have an abundance of rights. Also, what about an order of protection? Also, if she cannot be found, how can you pay the rent?

well I'm not sure what the laws are in your state but I know in FL you cant force anyone to move without going down to the courthouse and filing a 3 day eviction. then the sheriff will post it on your door and you have 3 days to pay or move. after the 3 days they padlock your door and you lose all your belongings.

best advice is pay up and get out.

as far as the crazy landlord, since you already notified the police there is nothing more you can do

If I were you I would get out of there. You can continue talking to the police and sue the landlord if you want to. You may in the right but what good will that do you if you or somebody in your family gets shot? Your landlord may have to go to court to evict you, but not if you have a bullet between the eyes.

Depending upon where you live you can contact a renter's association for help. Also, contact your child services office and tell them she waived a gun in front of the kids. Contact the building owner and negotiate a plan to pay off your debt. Also, find additional income like a second job which will show intent to be accountable.

the landlord has to go through court to evict you, and now because of this situation you described, will her case in the end because of the threat and with a deadly weapon. since you called the police, call an attorney and ask for advice. if you are not able to afford an attorney call the court system and ask for the free legal services number for assistance. good luck and thank your lucky stars evey one is ok

You are ridiculous. You run an in home daycare and dont pay rent?? So not only is this your residence, but its your place of business as well? I wouldnt have given you 30 days notice either. I wouldnt have waived a gun in your face, but I would have taken all your crap and threw it on the front lawn.
