If the 16yo had not reached the age of consent for the sovereign state wherein the act was committed, then yes, he can. I suspect, however, that is not the case and he is beyond the law, on this occasion.
However, even if innocent, that doesn't absolve him from being a dirty old man of dubious morality and intellect. Then it would be quite proper to vote for any of his opponents at the next election.
Better still, you could have him de-selected as a candidate before any such proceedings. That way you would be rid of an undesirable and still vote for his replacement should your political view dictate.

I don't know what the law is on this , I mean the kid is of legal age. If he can be , a lot of people may be facing prosecution...If its okay for a congress man to have sex with a male page how can it not be okay to send sexual innuendos through an IM ?

Since the relationship apparently was not physical, I believe the most he can be prosecuted for will be solicitation and perhaps contributing to the delinquency of a minor.

I think that his emails, at least so far, do not go so far as the law requires for a criminal prosecution. He so far does not seem to have solicited sex. However, at least one did suggest that an underaged person meet him at his home "for drinks" and that email also mentioned that they would have to meet at his home to avoid "getting arrested." So I think that something could be made of that, like contributing to the delinquency of a minor or the like....

Rush says 16 is the age of consent in Florida. If that is true, I don't think the page's age will have any bearing as far as the law is concerned.

MAYBE FOLEY CAN GET THE SAME SENTENCE THAT THE TEACHER LAFAVE GOT. She was that female teacher who had sex with her 14 year old male student.. She lost her job, and is on house arrest for like 3 years. she set precedence don't you think? After all men and women are in fact equal (said sarcastically)

In the UK the age of consent is 16. I've always believed it was the same or younger in some American states.
