My friend's friend created a phony account on myspace.com and saying she's someone else using a complete stranger's pictures as her own. She's even given out her cell phone number to these guys she's met. But it's not real, can she go to jail for this? She's 16 I believe and has a lot of guys going crazy for her. I think it's wrong, what do you think? Can she be tried for anything? What's your opinion on this matter?

1 your friend is some what stupid she give out her cell number her mother should remove her from the net she is been verry stupid as for phony account well never give out your real id and address with number in that is security dont put things like address phone numbe date of birth using some other person photo well if that other person see that your friend is using her photo to make out to the guys its her then that person can have something done about that ,your friend is verry stupid to give out her cell number to anyone

Are you afraid that some older guys may initiate a sexual relationship with her? I'm not sure about the law in the place where you live, but it is usually the adult who gets prosecuted. The adult could of course argue that he/she was under the impression that your friend was over the legal age. I don't think your friend would be prosecuted at all. Maybe for false identity? I'm not really sure about that. It'll be fairly difficult to make out a case on your friend because anything over the internet can be changed or deleted easily. Anyway, it is the duty of the adult to resist temptation, and to make sure that the person they're with is over the legal age.

Identity theft is a crime. I don't know if the authorities would do much about it since it's "only" MySpace, but it'd be worth reporting it. That way if anything does happen in the future, at least there is record of the fraud being committed and the person committing it can be prosecuted.

The fact that this person is only 16 is in her favor. They're really cracking down on minors and MySpace...as I'm sure you've seen all over the news.

She can get kicked off of myspace, but as long as she's not doing anything illegal with her fake persona she's not going to go to jail...now if she starts scaming money or things like that then yes, she could be prosecuted.

I don't know much about the law, but I don't see how anything there is illegal, if she isn't doing something for personal gain.

It is of course wrong, and maybe more importantly, dangerous.

No. What she did is not illegal. Stupid, perhaps. But not illegal. Giving out her cell phone number and meeting MySpace creeps could put her in danger.

I think the pervs deserve it. I doubt she'll get into any trouble unless she like defrauds them out of money or something.
