Old credit card. Hard financial troubles and haven't been able to pay anything on it.

If it is just the basic card and you just got overextended and eventually couldn't pay then they will just put it on your credit report for seven years, harass you by mail and telephone, and if they think you have money they might take you to court. If you purposely maxed out the card and quit paying, you could be charged with fraud.

If you're talking about an old credit card bill and you are unable to pay the credit card company, then the answer is "no".

On those facts, it isn't clear that you presented the card without any intent to pay, so there's no wrongful intent if you used the card with the expectation of honoring the debt but were simply unable when it was presented.

In addition, you didn't steal any services from the credit card company. If you used the card without intent to pay them, it might be "fraud" or "theft by deception" but certainly not "theft of services".

What do you mean by theft services? Was this your own personal credit card that you charged things to and just never got around to paying them off? If thats the case, then no you won't be arrested for it, but they can drag you to court and start garnishing your wages.

If you used someone's credit card that didn't belong to you, then yes you can be.
