Divorce in countries like India will take so much of time that you will be pretty old by the time your are a free bird. The best thing would be to seek somebody of the opposite sex from the court itself as both of you are having court litigation you can live together discreetly and enjoy the life and if luck prevails you people can also get married at a later date.

You need to get (and file) a quit claim deed from your ex., that is the only thing that confirms it.
