According to federal special education laws, called IDEA, schools CAN test the child for special ed even if the parent doesn't agree.
But the school first has to make every effort to get the parent involved in the process. THey can't just do testing 'right off the bat' without first working with the parents.
This is not mandatory though, and schools have the choice of whether to test a child if parent disagrees.
For the most part, schools won't bother to test a child if parent disagrees. As long as you don't sign a parent consent form for testing to be done, it should be fine.

Another thing, schools are not legally obligated to help children with ANY problems UNLESS the child is in special ed. Schools will 'say' they will help, but this help can stop at any time if child is not in special ed, and usually does stop.

It depends on how much help the school thinks your child may need. If they think your child had a learning disability they may decide not to do the evaluation. However if they think that your child really needs help they may have a due process hearing to require an evaluation. These hearings are expensive and schools would rather not have them. Often they will not do the evaluation if the parent doesn't want it done.

I don't think the school can do anything unless the child's not meeting the standards set. You always have the option to have your child tested independently and have those results submitted to the school. That may be the best action if you feel your child doesn't need special help.
Sometimes a child only needs the help for a limited period of time. If your child needs help in school it really is nothing to be ashamed of...the schools now are far more advanced than they were just a few short years ago....good luck.

Then you cant evaluate the child. The parent has the final say on how their child is educated.
Sad sometimes, since we teachers went to college for years and are the professionals.

it doesn't hurt just to have him tested. are you in denial that your child have a problem? It does hurt to have your child to have a leaning disability. All parent want their children to be doctors and lawyers. Both of my boys have a L.D. JUST HAVE HIM TESTED. ASAP

That child suffers greatly because his/her parents are too selfish to get the child the care he/she needs. Sad, sad state of affairs when parents do not act responsibly and put their children's needs first.

You do not have to have it done.My opinion is a lot of kids get stuck in special ed when teachers do not want to deal with them.
