Ive gone and lost my copy of my contract with Orange.
Ive just upgraded but would like to cancel it (I dont mind sending back the handset) and go onto a new network (the only network which provides the phone I want).

Can I simply phone up and cancel my contract?
And will I have to send the phone back?

If you have just upgraded you have two options - first one is that you have 7 WORKING days from the day after receipt to cancel your upgrade for ANY reason (even if you don't like the colour of the phone). This is the EU Distance Selling Regulations. E.G: If you received your phone yesterday (3/10) you would have WED, THU, FRI, MON, TUE, WED, THU to contact Orange and let them know. They would send a collection bag to your address for you to put the phone and all the literature and send it back (they will not let you keep the phone as they paid for it, and the way they get their money back is by you being in contract).

The 2nd way of doing this is the 28 day sales of goods act. Should your phone develop a fault within 28 days (you would need to ask Orange to run a diagnostic to generate a fault code) you are within your rights to cancel the upgrade which in turn would cancel the contract - again you would need to return the phone in the collection bag that they would send.

If you are outside 28 days - you're stuck. They have a migration policy in place which means that for the first half of your contract - you can NOT switch to a lower service plan, and as you accepted the T's and C's when you upgraded, you are legally obliged to 'buy' yourself out of the contract - this would mean paying all your line rental in advance, e.g. You are on a £30 month package on an 18 month contract and you've started your 2nd month - you would need to pay 16 MTHS x £30 = £480

If your minimum contract has expired, yes, you can.

It all depends on your plan. Most are 12 or 18 months minimum contract. If you've gone past it, you should have no problems. The only time they would cancel it before that, is if there is some kind of legal requirement that requires them to. It's hard for me to explain, so I hope you understand.

if you have been with them for more than a year then you can cancel the contract and keep the handset but if it's under a year you will have to paid then a cancel fee.

Best bet is call and get information. Cancellation fees are on the contract. About the phone...I havent the slightest. Call them.

my partner is with orange and wanted to cancel his contract, when he spoke to orange about this its VERY VERY expensive to cancel it so hes just waiting for the contract to run out, only a few months left now!

you can cancel your contract at anytime, giving 1 months notice in writing. however, if your contract is still running, you will have to pay the remaining months charges as a cancellation charge.

yes but you will be charged a cancellation fee if you wait 2 months thewn you can cancel for free

Without knowing what your contract says or how long you signed up for etc. its impossible to tell you. Call Orange customer services - they're the ones to help you.
