he has sent several family members to yell at me and my son and let something slipped,im afraid they hurt us.

It doesn't matter who files for divorce..you or him, either one can; but yeah, he can, just like you can to. You need to also consider getting a restraining order (50-B) maybe to protect yourself and to keep him off of your home property if you are afraid of him. I know I would.

Yes either party male or female can file for divorce. an example I know a person who was married 28 years has four children and the husband left the wife for the secretary and there going through a divorce.

No he can't, although it sounds like he's a real jackass and you're better off divorcing him anyway. He can file papers, of course, but you'll still need to sign them. Get yourself a lawyer and don't sign anything until your lawyer has read it.

But no, as long as you are accessible (still in the state), he can't just divorce you without your say in the matter. Especially when there is children involved (is your son his child as well, or was he from another relationship?)

Upto my knowledge you have done a bigamy as per law. If your first husband is able to prove this second marriage in court then you are screwed for sure.. The other crime you have done is you have cheated your second husband too .. before marrying him you should have informed him about your first marriage issue. Its double cheating. I think for bigamy you will get 7 years improsonment. The best thing is try to sort out the issue via mutual consent.. thats the best.. Is ur second marriage is also registered.. then for sure u can be easily screwed by your first husband.. try to give lots and lots of money to him and solve the issue.. thats the only go. Why u left your first husband.. you say he was over possessive.. means was he possessive over you or some other.. if he was possessive over you and if u had left him.. then you are not a good girl... u r not eligible to be respectable woman.

ANYONE can FILE for divorce without the other spouse's consent. But he still HAS to serve you with the divorce papers. He can't get a divorce from you without your signature, and first he must get a legal separation which also requires your signature.

Typically people who are getting a divorce don't go together to file the paperwork. One person file the suit against the other.

Don't know about where you live but where I am from he can divorce you (finalized) without your permission.

Of course he can file for a divorce with out you! No one needs anothers permission for a divorce!

There is a cheap divorce where all parties agree, this is the cheap one.

The other one cost more, and it don't matter if anyone agrees or not!

Well, there are just some things he doesn't need your permission for, even after 22 years of marraige. If he wants a divorce, he can file with or without you.

yes, he can.
On any given day there may come a knock on your door and it will be someone serving you papers to legally initiate your divorce.
All this is easy to initiate on his part, all on his own without your consent. If you don't agree with his suggested outcome (suggested settlement in the papers served), he can impose a court hearing to further force the issue. That's when the attorneys really suck your finances dry.

yes he can but you will get papers at the last address that you lived at if thy come over to your house call the cops thy can\t hurt you then
