Neighbor hears yelling or screamming which was tv with surrond sound. Police came to the door after movie was over.The house was dark and every one was in bed. They told that because they recieved a 911 call then can enter my home. Even though the were no signs of trouble. I understant that if the 911 call came from inside my home then they can look.

Yes, they can enter your home and without a warrant. The 911 call sets up exigent circumstances which is an exception to the warrant requirement.

The police have kicked down the wrong door on drug search (and probably other) warrants and shot people to death. CAN the police enter your home if a neighbor calls 911? Oh yeah - and some departments even have tanks now.

May the police do so? Hopefully, you live to tell the tale and hire a civil rights lawyer.

If police believe they are witnessing a crime - is that a marijuana plant in your window, is that a burglar's flashlight they see - they'll argue they can. if the neighbor is worried about you and wants you checked on, can demonstrate a reason to believe you're hurt or dead inside, the police usually won't until days pass after the first report and the concern remains. If the neighbor is concerned and there is a foul and strong stink, the police will go in.

If they don't enter on the basis of a crime, and only enter to check welfare, and then discover evidence of a crime, they would need to go back and get a warrant name this evidence and get permission to come in and get that evidence or arrest you based on it.

If a neighbor calls 911 for reasons having to do with your health or welfare, the police may enter your property to check on your well being, period. If your neighbor calls the cops over your welfare and they start to enter the home and you stand at the door and explain that you are fine and not in need of their services, he may not break the door down to make sure no one is holding a gun to your head. If your neighbor calls 911 and says you are smoking pot or doing something illegal the cops may not enter your home without a Search Warrant signed by a judge and include an Affiant, who swears that he has witnessed a crime or something illegal.That's the Law. (The Laws in America have changed allot this month, I imagine that if someone would swear that you were terrorists in there they could do anything they want, regarding. If not they must show a Warrant , or have reason to believe you are hurt or in duress.

There are many circumstances whereby police can enter your home without a warrant. A 911 call would be one of them as they have the right to rely on the report from a concerned citizen.
If the report turns out to be a hoax then the neighbour can be charged with public mischief and you have recourse against the neighbour in civil courts.
If in the course of their investigation, they come across some form of contraband in open and plain view, then they have the right to charge you.

What is all of this talk about warrants? It really does depend on the situation. If 911 was called because it was 3:00am and your music was too loud, well then no. If the 911 call was for screams and gunshots fired, look out.

I suppose the policemen would check on you if your neighbor calls 9-1-1, and they could save your life if you hadn't been seen in a while and it's not in your habits to not go out or go on a trip without mentionning to your neighbor. Unless you are not getting along or you have something to hide. But I believe they would check if everything is all right with you before entering, and they found something is suspicious.

You bet they can enter your house, if the neighrour called about domestic violence in progress at your house. That is serious. Or if you had some party out of controll with drugs in there. Oooooh, i'm sure the police will love to come to your house for that one!!!!

If the police feel there is a VALID reason to enter your home and there is exigent circumstances--they can--however--if you answer the door---and are standing there---and there does not appear to be a problem--they cannot just BUST down the door for no reason---

I think we need more background on this and you are not relaying all that happened. Was there a medical emergency?? Did they find something that you did not want them to find (in Plain View)?

Police are not jerks for doing their job. in case you do not favor them putting round, be polite and cooperative, and they leave. they truly do have extra perfect activities. even with the indisputable fact that, there are required to respond to each and every 911 call. What might want to be the point of it in the journey that they weren't? you chosen to strengthen the concern into some thing else, through refusing to get your identity, and throwing a tantrum about some rugs. (heavily?!) And for being smug adequate to imagine you're in a position to furnish orders to regulation enforcement officials. they don't seem acquaintances you could ask to attend in the parlor. they're given a position of authority as a fashion to do a job. you do not get to inform them the thanks to do it. Your fault for being the jerk. BTW, i'd have observed you to that mattress room, too. As irrational as you've been behaving, that they had good reason to imagine you've been headed for a weapon.

I believe so....normally the police has no right to barge into your home without a warrant.......but in an emergency situation....yes....they have a (not a right) responsibility to check out and address what the emergency is.......and take the appropriate response!

We should not be too overly zealous in guarding our 'right' to privacy in certain situations........we, as intelligent citizens.....should recognize as and when the police be given some leeway to perform their duties......otherwise.....why the hell do we have police for!
