My mother recently passed. In the will she left me the house and contents. She had it set up in a trust that my brother's friend drew up to protect me from taxes. My brother is exec. of estate and p.o.a.. It also shows he owns the trust. How can I get the house in my name since I'm living there and paying the mortgage?

You don't own it. You just benefit from all the little houses that it spawns. Good Luck! :)

It appears that the trust was not set up properly. You need to contact a lawyer on this one or your brother should allow you to take ownership of the house per your mother's wishes in the trust. He would have to sign the house over to you and file it with the proper department.

You would need a copy of the trust and it would of had to be recorded into the trust for it to be valid or funded. Otherwise you would need an attorney.
