My daughters then boyfriend gave her an broken computer, and said if she can get it fixed, she can have it for her daughter. Well, she sent it off to be fixed, and before the computer was done, they broke up. Now she has the PC back and working, he said she owes him money for it and if she don't pay, he'll have the police go over there with him. What can the police do? And would they even bother with the situation?? Thanks!!

They have an oral agreement. Be sure she keeps the receipt for the repairs. He really doesn't have a case but if he thinks he does, it would be a civil matter, not a criminal matter so the police wouldn't bother with it. He could sue her in small claims court and if he does, be sure she answers the suit and brings her receipt to the hearing. And ask for costs (of having to answer his lawsuit), and any other costs she incurs.

The Police will not do anything. They will tell him that if he wants the computer he will have to lodge a claim in the small claims court.

He will then have to prove to a judge that the computer is his and she will have to prove that he gave it to her. That will be hard but the fact that she has the receipt to get the computer working will go a long way in her favour.

I think it is a "civil" matter as opposed to a "criminal" matter. I doubt the police will worry about it. It sounds like a small claims court matter. You could simply call the police information desk, explain the situation and ask... It's what I would do.

This would have to be decided by a civil action. The police are only interested in items that were stolen. Where there is doubt as to the ownership they won't get involved.

he gave her a computer and there is nothing he can do. I am sure the police would not go get it. the most he could do is file a complaint against her and then they would have to go to court to settle it. I would not worry about it.

well she will be able to keep it if she have proof that he gave it to hurt. She need to have a witness,and her receipts where she got It fix. then go to the police before he does.

I would say that since she had it fixed, and HOPEFULLY kept the receipt she can say to the cops exactly what he said~ if she gets it fixed it's hers, if the cops say to give it back, tell him to pay the money it took to get it fixed~ OR BETTER YET~ DONT INVOLVE THE COPS, TELL HIM YOU'LL GIVE IT BACK, BUT TAKE THE MOTHER BOARD APART, OR DOWNLOAD A VIRUS INTO IT!! :) hee hee. evil.

can he prove that the computer is his? does she have a receipt for the repairs showing that she paid for them? he'll have to prove ownership. if he gets it back then she can take him to small claims court.

the police could come with him to "ask" her to return the puter...... but if she says no there is nothing they can do.
it is a civil matter and they will have to go to small claims court...... but, no police cant help him.
