Call the company every day asking for your money back. You have to be very persistant. Threaten with a lawyer. It may turn out that you will need a lawyer, but you will get your money back. This is not legal.

If you are not approved for a mortgage, they must give you your money back.

Mail the bank (or whoever has your deposit) a certified letter, enclosing a certified copy of the mortgage denial, and a date (within 7 days) that you want your money back.

If you wrote a personal check for the $30k, put a stop hold on it - if they deposited the check in their bank, your bank will pull the money right back out -don't worry about the $40 fee, it's well worth it to get your money back.

If they refuse, then sue them in court for the money, interest, fees.

If you put that money down, and didn't get approved you are entitled to getting it back. Normally an offer to sell is contingent on getting approved. You just show the sellers agent your letters of denial and it should be given back. What city are you in and who is your agent? Doesn't sound like they are doing a good job representing you.

Not enough info. who did u give the money to? Was it non-refundable? I hope not..sounds crazy to do that. If it was through a real estate broker sounds like they need to be stalked. Don't know what to ttell you. I'd threaten them with a lawyer if that's what it takes. good lusk

with new construction houses, only way to get your deposit money back is to give them a letter with credit denial, but if you use builder financing company, maybe you should go and look for the mortgage with different mortgage company. is your credit that bad?

Spend an hour with an attorney who specilizes in Real Estate. You will pay an hourly fee and its worth it.

Be sure to take with you all your documents.

Good luck.
