In Canada the child has to be twelve...however, the child doesn't make the full decision...the judge will consider the child's choice when awarding custody...hope this helps.

I think that age should be 26....Honestly, I don't think any child should have to go through a pair of divorced parents and have to pick between their own mother and father. Kids are innocent...they are childish..they shouldn't have to be put in that kind of place where they are forced to pick between something that will effect their life especially when they don't even know what's best for them...If you're going through with a divorce...I don't know what to say...the most I could hope is that somehow you and your husband get back together...it'd probably mean the world to your child too. And if that's not possible, I'm not sure if this is possible...but maybe your chld could take turns living with you guys. I seriously feel that a child should never lack the love of a mother nor father. Just one is never enough...a child is made by a mother and father and a child should be raised as well as loved by both a mother and father. Not just one. It all depends on the state that you live in. Mississippi age is between the ages of 12--15 last I knew. The real sad thing is that a child has to go thru that,because a child loves their parents unconditionally no matter what has happened. I would just hope that the 2 parents could be ADULTS in a matter like that & work the differences out before a problem like that came about.

It varies per state or country. Most however start to consider a childs preference at about age 12...with each year after 12 the consider more and more....

A lot depends on the situation of the parent of choice. Are they the best suited to care for the child? etc.

Call a lawyer and ask in your specific location to be sure of the options.

It's never appropriate to put the child in the middle and make them choose which parent they essentially love more. Why should the child have to make the tough decisions if it's the parents who are having the problems? If your children asked you to pick favorites between them, you wouldn't - so how can you ask the same of them?

If the child has decided (on their own and without pressure from their parents) who they want to live with, then the parents should consider their child's preferences and the reasons for those preferences.

You gave yourself the answer in your question..a Child.Theyre called children because they cant make these decisions.In my opinion,the child doesnt know whats best for them,but the parent that has always has custody does.I think once the custodial parent has been declared in court for the first time,that should be the end of it until the child is an adult.Unless of course something major has happened as in health of the custodial parent or abuse.All the court dates back and forth is selfish of parents.It just makes things traumatic for the child.Let things be if the child is ok.

I have never understood why a "Parent" would make a Court decide where the child should live. Unless on of you is a unfit parent then why not let the child decide REGARDLESS of there age. If little johnny wants to live with Dad...then so be it and if after a year or so he wants to be with mom....then that's okay too....just don't let them go back and forth a whole bunch of times. Remember they are kids....and they don't have a clue whats going on.....so don't make them stress over it more than they already are.

A child should never choose! You're the parents, you should be making the decision for what's best for him/her. Asking her/him to choose only puts them in the middle! That being said, I believe legally it's 12, but not sure.

Its not an age limit..it depends on the childs intelligence.

Unless you are in a bad abuse situation..I would hope you wounldn't even think about making a child choose. The child loves you both. Don't force it upon them because it will backfire on you.
