my home has been listed for seven months, i just received a copy of the listing agreement that i signed but never got a copy, was never told about the length of it. thought 60 to 90 days but found out it is nine months, am having problems and want to get rid of him.

Nine months? In this market...no. This is a decent market and if its still not sold in 9 months, one of the following is wrong:

- location
- list price
- condition of the home
- lazy realtor who isn't marketing your home to other realtors or the public.

The usual contract is 180 days (6 months), but if the contract is 9 months, it's 9 months. You can't get "rid" of him - in fact, if you sell the house on your own you still owe him a commission.

Next time, have a new listing, try to get a 90 day listing only (so you can have a fresh MLS number) - and have the realtor document everything that they will do for you and how often - virtual tours, inside showings, auctions, open houses - so you know what you're paying for.

You can still sell houses in this economy, but you need to have someone who knows what they're doing, not a part timer just trying to collect commissions.

Damn! Dude, if you haven't sold your home in seven months there is something wrong. It is :a) asking price too high, b) something about your home is turning off buyers or c) you have a deadbeat realtor. (or a combination of the three). If he is really dragging his feet or possibly incompetent, go to his boss and spell it out. I doubt you will have any problem getting released after this length of time. Realtors are just one minor rung above lawyers on the ethics ladder; they lie, they cheat, they think they know everything and they will tell you to your face exactly what you want to hear. You need a realtor that isn't afraid to tell you why your house hasn't sold. Many times it's just a matter of putting a load of your personal crap in storage and rearranging the furniture that moves a house into a sale. Sadly most home buyers see the decor instead of the house itself (a little trick I picked up over the years). Try to catch a couple of episodes of 'Designed to Sell' on the Home&Garden network. It's eye opening and could make you thousands.

John, nine months is to long. 3-4 months is reasonable and your agent will work harder on your behalf.

Like the other comments something is wrong with price or marketing or a combination of both.

Here is the "Key" to your issue. If you were not given a copy of your contract during the listing, you do not have a listing.

Call the broker and discuss this issue and put it in writing that since you did not recieve a copy of the listing, you are advising them to withdraw.

If you do not want to do this make an appoinment with a lawyer.

In the future interview 3/4 agents prior to listing, and discuss with each of them marketing and pricing.

I'm a Utah agent. i would never list your home for 9 mo unless i told you that your home is going to be real hard to sell say its un insurable or the top 1% in the market underground etc... but if it is a fairly average home ether you are asking too much or your agent is lost

Nine months is too long. Six months is standard. I always insist on a three month listing, it makes me think the agent will work harder to get my house sold.

If a house is left on the market too long then the propety value goes down so I would pull it and wait a couple of months before you try to sale it.

have you ever seen that show called "sell this house"? if so, then you know what to do to sell it . if not, then take all your personal things, paint it, clean the yard..do all the things you would want done if you were buying it. 7 mnths is a long time to be on the market. what's the avg time in your neighborhood?

Was it written on the contract that you signed? If so, you are legally bound to the contract. If not and that's just what your realtor is telling you to, then you can drop him/her anytime you like.
