A quasi-contract, also an implied-in-law contract, is a legal substitute for a contract. A quasi-contract is a contract that should have been formed, even though in actuality it was not. It is used when a court wishes to create an obligation upon a non-contracting party to avoid injustice.

An example of a quasi-contract is the case of a plumber who accidentally installs a sprinkler system in the lawn of the wrong house. The owner of the house had learned the previous day that his neighbor was getting new sprinklers. That morning, he sees the plumber installing them in his own lawn. Pleased at the mistake, he says nothing, and then refuses to pay when the plumber hands him the bill. Will the man be held liable for payment? Yes, if it could be proven that the man knew that the sprinklers were being installed mistakenly, the court would make him pay because of a quasi-contract. If that knowledge could not be proven, he would not be liable

Quasi-contract is an equitable substitute for a contract sometimes recognized by the courts. Basically, it means that parties had some sort of agreement or arrangement that is not a legally enforceable contract, but where one of the party suffered damages in reliance of the believed agreement. Courts sometimes decide that a quasi-contract exists when one person accepts unjust enrichment that would otherwise be unfair. For example: imagine that your neighbor gave you $50 and said, "I'll give you $50 every week to mow my lawn." If you just take the money and say, "whatever," no contract has been formed. Now imagine that some Good Samaritan mows the lawn for free. If you keep taking $50 every week, you will have been unjustly enriched by the your neighbor's misunderstanding, and a court might rule that it constitutes a quasi-contract and require that you pay back the money (or provide the service) as if a contract had actually been formed. Anyhow, there's an ok article about it on Wikipedia, so I probably spend too much time explaining it (they have a better example too).

my friends Shawn who owns a landscaping company mows an elderly woman’s yard once a week for the summer, although there was no written agreement there is knowledge of the benefit that my friend shawn is providing. Is that an quasi contract?
