Why wait 10 years to cite that if your considering a divorce?
Has the marriage not just broken down over the years despite your best efforts? That then is not so much to do with the adultery that happened way back then. Adultery even then, was probably more a symptom of your marriage problems that you had even before adultery was ever committed or your partner falling out of love with you.
Obviously you have both tried to make your marriage work since the affair happened. (I'm in the same position) but I'm also aware that even taking a cheating partner back, even with the best will in the world to repair the marriage, it can usually after several years result in the marriage ending.
For most people they later find that, taking a cheating partner back is a lesson in futility and often they regret the years that they wasted. But of course no one knows that or wants to believe that until they give it a try...that's if they do decide to give their partner another chance, and even then, it doesn't need any other third person to help breakdown the marriage, even at a later date over the years.
Remember, any differences to do with you considering a divorce now, are to do with both you and your partner, not a third party.
However, I do think you can cite this in a divorce petition if you want.

You can divorce anytime without a reason but if you want something out of it...... It depends how long you've known. If you fond out 10 years ago questions are going to be asked why you didn't divorce then but if you've only found out recently it's a different story even if it happened 10 years ago.

Of course...just because it happened a long time ago doesn't mean that the affects from it having happened don't play a role in your marriage not working. Truth is you really don't need a reason to divorce other than saying irreconcilable differences.

Just because you can't use adultry as an excuse doesn't mean you can't divorce them!

You do not need a reason to get divorced these days.

Irreconcilable differences is the reason. You just don't get along.

If you want to get divorced you don't need a reason.

If it took you 10 years to "GET MAD ENOUGH" that he cheated on you, your problem seems to be deeper than you think. And you don't need a reason to get divorced, because apparently your not happy or you wouldnt be thinking of it now.

Seems that there is more to the 10 year old adultery thing than you're letting on isn't there?
