I used to think that Judicial Review was not only unnecessary, but unconstitutional. Given the increasing powers that the Executive Branch has garnered over the past century in general and particularly in the past 5 years, as well as the "lapdog" oversight of Congress, it's apparent that Judicial Review is VITAL in safeguarding our rights against an overzealous and all-too-ambitious government.

Judicial review ensures that Congress is passing laws that do not violate the U.S. Constitution. If Congress and Senate disagree with Supreme Court rulings, they must try to amend the Constitution. The myth of "activist judges" was started by the conservatives and only applies when they disagree with court decisions.

ABSOLUTELY.

Were it not for the Court system, people would have run roughshod over the rigths of the weak and the minorities on countless occasions.

For crap's sake it wasn't that long ago that there were different sets of laws for black people and white people. 50 years before that, there were laws that said white people could use alcohol and drugs, but Indians, Blacks, and Chinese could not.

Without a court system, our government could pass laws like that again (not exactly, because I don't think it would be tolerated in at least 90% of America - the other 10%, who knows?).

I think anyone who thinks the Court System should be altered is truly un-American and would spin the Founding Fathers in their graves.

Our government is working. We have been screwed countless times by judges since the 60s. We need to clip their wings, a little. Its a little scary that you are so ready to dismantle the Constitution.

Yes. The legislature is likely to pass uncostitutional laws without it.

Unfortunately, there is no one who is second checking the rulings, so judges are just ruling things they don't like as being unconstitutional, even when it isn't.

Absolutely, the third branch of gov't completes the checks and balances that the founders had intended.
