It alway used to be a minimum of 24 inches from ground to the centreline of the headight when loaded normally.
Seems to me it could be legal with a bean pole riding it and not with some fat bloke.

I've never checked the headlight level when inspecting a motorcycle. As long as the high & low beams work, I'd let the headlight requirements of the inspection pass. Call your local motorcycle inspection station for their requirements.
