I was in a no fault car accident in Oct. 2005. I did not have gap insurance so they only paid for what the car was worth leaving me with a balance. The car is totaled (ofcourse) because i am no longer working full-time, and enrolled in school fulltime, I made payment arrangements with company for what i can afford. Apparently they thought i was lying and attempt to do income verification etc.. So they have aggreed to accept the arrangements. Since then they have ask to settle for an offer which i had to refuse because i did not have the funds. So i continue to send the monthly agreed upon payments. they send me reminders about the payment etc. Recently they sent me a letter stating that they are canceling the payment agreements and that i have 7-10 days to pay the entire balance. They also said that if i don't they are going to take legal recourse, and this will be placed on my credit and affect my chances of getting a job. Is any this legal or even possible?

I'm not a lawyer but it sounds like scare tactics if you have an aggreement signed and a student I would contact the better business bureau its free and they can give you advice on how to handle this company.

Well if the agreement was verbal, then its legal. Verbal agreements cant be proved or disapproved. However, If it was a signed contract then its illegal. Given you pay your full agreement ammount. If you viod the agreed ammount in the contract, then they can file for full immediate payment for arrers and faulty consumer payment. Before you grab a lawyer, dispute the claims over telephone, or in person especially if you have a written and signed agreement (contract) and can show moneyorder stubs, credit card statements, check statement, or anything that proves you've been paying the agreed ammount. Alot of times, its a faulty error in their systems.

Also, by federal law, no job can discrimminate on the basis of race, age, sex, maritial status, sexual orientation or physical income. (that includes credit) credit checks arent done for job interviews and employment, they do crimminal background checks. Not credit checks.

Filing for loans, some rental housing, morgage, and auto do credit checks.

That does not sound legal. I have always been told that they cannot refuse a payment arrangement of any amount as long as you are making payments. I think it's time to call a lawyer!
