well first of all you chose where to live , if living in apartments and condos is your thing then , having cheap paper thin walls and loud neighbors is something you had better learn to deal with , try moving to a house ........another thing to keep in mind is the guy probally isnt doing anything all that noisy but it is morethe way these places are designed they tend to be noisy , I had the exact same deal at my place , I got to know the guy upstairs a bit, he was over at my place one evening and his girlfriend was upstairs at his place we were talking and all of the sudden he says what in the hell is that noise , it turns out that just his girl walking across the floor was real loud , so if they did anything like moving a chair or housework it was horrible ......we learned to deal a bit but finaly have a house and it is way better ......you just may have to deal with it because I bet to him he thinks he is doing absoutley nothing wrong which may infact be the case, but your different schedules make it so you are resting while he is doing things so the noise is all you can hear or think about ......tough deal , maybe try some earplugs at night while you sleep ......

I live in a condo, too. Ask the HOA to write him a letter. Go to the next meeting and propose a new rule if you don't already have one about noise after 10 PM. There should be no loud TV and no other noise caused by washers, dryers, dishwashers, etc. after that hr. Explain your situation to the board. If they don't act, I would warn the neighbor that he is disturbing the peace and you will have to call the police if he doesn't stop.

Go to who ever you pay your rent to, say I can"t sleep, so their for, if this persist, I am going to get a lawyer, and will have break my lease, also I would call 311, every time this happens, and report a disturbance of the peace, the police will come, get a block watch number from the police department, that way you will not have to give your name or phone no. The more call you make the better, also don't forget to write down the confirmation number from 311. or 911. This way you will have more proof, to back up your case, do not approach your neighbor.

If you call 911 for something that's not an emergency you're going to be the one that gets in trouble. 911 is not the number to the police station, it's an emergency life and death situation number. Find the number to your local police station. Again, DO NOT CALL 911 FOR SOMETHING THAT IS NOT AN EMERGENCY!
Try talking to the landlord and make an official complaint first. Then when you DO call the police station, there is a record of complaint(s).

Do you have a land lord you could speak to? Apart from that and asking him politely if it's really a big problem maybe a few words from the police would make him see how bad it is. Don't call 911 though, try and visit your local station and get advice from there.

im sure the local police have a non-emergency number where a squad responds. i know how you are feeling. all of the downstairs neighbors kids play music loud and i go down and ask them to turn it down and sometimes they do or dont. then i go right back down there. i have called the law plenty of times and told the landlord which doesnt seem to care. i cant stand it. i work from8-4. i dont have time to play games. have you talked to the owner of the building? oh yea i've used a broomstick to hit the floor and it ticks them off.

Try communicating with your HOA by letter. Give dates, times of the offense and make a copy for yourself. Sometimes people will not take you seriously until they see it in black and white.

Find out when he sleeps, he has to sleep sometime, and make all the noise you can, pound on his ceiling with a broomstick and blast your music with a speaker as close to the ceiling as possible. Make that jerk as miserable as he has made you.
Sometimes it takes you being as annoying as he is to get your point across.
