First of all, when a lorry is reversing you have to provide a 'banksman' in the UK to stay in line with health and safety at work requirements. The fact that they didn't see your husbands vehicle parked there means that there was no 'banksman' or tha he didn't do his job properly. You know there could have been a very important client standing there in the wrong place. Would they have hit him instead? Anyway, having reverse beepers on the lorry is just not enough. There might be a deaf person who doesn't know a vehicle is reversing, that's why you have another man (the 'banksman') to check for these things, and other. So, your husband should not be having a discipinary hearing, instead, all personnel must be sent a memo or something to tell them that in the future off rout parking will be not tolerated and may result in wheelclamping or other restrictions.

Sounds like a real snafu for your husband.... I use to work at a very large energy company that had company vehicles and I wondered about certain circumstances if there was an accident I was involved with.... I realized in some instances I could seriously jeopardize my job if I was grossly at fault. In this instance it sounds like your husband is in trouble cause there is an eyewitness collaborating the story of the other driver. Unless you can get an eye witness to back up your husband there is little he can do. If there was no injuries or serious damage he may not get too much in trouble but just a little bit in trouble. You might ask him to return to the area where there was the accident and look to see if any of the local business had a video camera on the area of the accident- someone might have it on video tape.
The company is obligated to follow the way the courts review accidents that is to say they must take the word of two people over one. Your husband may be best off playing it as low key as possible allowing the accident to blow over the course of time. He may just get a small black mark on his company record that most will forget about in a year or two. As for being off route it should not be that severe people go off route all the time just be honest about that... most will be able to detect his honesty regarding the lunch.
If he should get too emotional and obstinate contradicting the two other fellow employees he will probably look worst off then he already is being perceived by his bosses. If he just "takes it like a man" he may be better off even though they are wrong and he is right. Many times companies just don't look at you if you are right or wrong but look more at how you weathered adversity. So it sounds like it may be a case of having to bite your tongue and lip. I hope in the end it works out ok for him.
It may be best for him to write down what happened just to have a personal record- It is good idea to keep a diary at your job to cover yourself for any incidents like this one . Some day that might come in handy.

All driver's are responsible for the safe operation of their vehicle. Since the lorry driver hit your husband, no matter where your husband was or wasn't supposed to be, it is still their fault I think. They could have hit anything at that point: A pedestrian, a motorcyclist, or another lorry.

obviously the should have been looking, but the fact is that the insurance has to pay out somewhere and you'll probably find that there disaplining him more over the fact that he was off route, the company isn't covered when the car isn;t where it is supposed to be unless there has been a divertion of traffic. Its the same with alot of companys, buses lorrys etc.

Yes you are not allowed to eat or buy sandwiches when you work, companies expect you to go over your driving hours, work like a dog, then they discipline you when you make one small mistake. My thoughts are with you as this can be so stressful, companies look for any small dismeaner to get rid of you these days as they do not want honest workers they want all the drivers on franchise or agency staff. We are going back to victorian slave labour where the worker dare not speak up.

He shouldn't have been where a truck was reversing, he should have spotted the manoeuvre. However the HGV driver should have seen him move into his area and unless the passenger was out of the truck directing him he wouldn't have seen anything if it was articulated and if it was rigid the driver shouldn't have need help! The company should be concerned that one of their truck drivers did this and it was fortunate for them that it was on their property and not with a member of public. but knowing hauliers they do have their favourites that can do no wrong!

yes they should have loOKed when reversing he should be able to claim and if the company is good they will help him through this it is the over drivers fault not your husbands his he ok
