Try self help legal forms. Every court uses a format and you just need that format to file your own documents. No lawyer is needed for that.

I got you covered. First of all one has nothing to do with the other. As the bio father of the child you have rights. File for separation and don't be a wanker when the crap hits the fan. If it does come to where you are being kept from the kids, go to your local domestic relations office and file for visitation.
Oh and one more very, very important detail. Do not pay her child support without it being court ordered because it will be considered a gift and you will get no credit for it. And it does not matter weather or not you mark the checks child support it does not count unless it has been court ordered. You can even file the papers to get the ball rolling on that. I am not suggesting that you let your kids go without just cover your butt.
Bottom line you absolutely 100 % have rights. You just need to be ready and willing to have them enforced if need be.

You can obtain legal separation and still have the right to visitation of the child. If you are talking custody of the child, you will most likely get joint or shared custody, but full custody is very difficult to get away from the mother unless you can prove that she is an extremely unfit mother.
