My husband was sold golf clubs that we later found out were counterfeit. We are taking the guy to court to get our money back. What is the law regarding this? We live in West Virginia.

Selling counterfeit products is a violation of federal law (specifically, the trademark law) as well as - possibly - state fraud and consumer protection laws. Yes, you can be held liable even if you didn't know.

I think so. The guy should have known who his supplier was. But if this seller passed it on to your husband that they were counterfeit and he still purchased them anyway, then he has no case.
