the lady above me, is really giving you some GREAT advice....remember the laws have changed regarding the collection of bills, whether this one is yours or NOT..........they can NOT call before 8 am or AFTER 9pm this is your local time, NOT where they happen to call from..........

You need to state to them the words CEASE and DESIST.......make sure you get the name of the person you say this to.....tell them you are making this statement ONCE and ONCE only IF there is any other attempts to collect this money then you WILL take legal action........then do the follow ups like the lady above me said................you MUST get everything in writing and KEEP it for several several years.......we keep getting an ex wife's bs pop onto our credit report and we just send off the WRITTEN proof it is NOT ours and it will go away ONLY to come back again and again.

Have by your phone a note pad ask for the name of each person that calls AFTER the cease and desist conversation and then hang up, note time and date of each call.

Bcr Collection Agency

It's against the law for a bill collector who works for a collection agency (as opposed to working in the collections department of the creditor itself) to call you before 8 am or after 9 pm. The law, the Fair Debt Collection Practices Act (FDCPA), also bars collectors from calling you at work, harassing you, using abusive language, making false or misleading statements, adding unauthorized charges and many other practices. Under the FDCPA, you have the right to demand that the collection agency stop contacting you, except to tell you that collection efforts have ended or that the creditor or collection agency will sue you. You must put your request in writing and state that you do not owe the debt.

In most states, you may report the agency's conduct to the state Attorney General's office. You may also contact the Federal Trade Commission (FTC) if you have a problem with an out-of-state debt collection agency.

First thing you MUST do is pull all three of your reports to see what has popped up. If you haven't pulled your reports in a while something may have surfaced. If nothing has then I woul google them and find their mailing addresse and send them a "Cease and Desist" letter. This letter is a legal remedy that is afforded to you through the FDCPA (Fair Debt Collection Practices Act). Simply tell them that you want them to cease any and all communication with you as provided by the FDCPA. Be sure to send it Certified, Return Receipt Requested as proof they recieved it. If they continue to contact you then you sue them in Small Claims under the FDCPA. Hope this helps. email me if you need more help.

Tell them they are no longer allowed to call you, and you want the debt validated IN WRITING. Then hang up.

They know if they call you again you can file a FCC complaint against them. If they do call again, CALL THE FCC and actually do the complaint.

They have to send you written validation of the debt they are trying to collect, you can then dispute it with both them, the original debtor who sold them the account, and do a written statement on all 3 credit reporting agencies (Experion, TransUnion, and Equifax.)

Send them a Cease and Desist letter. In this letter you must tell them to stop contacting you, or use the exact term, "cease and desist from contacting me regarding this account".
Tell them in the letter you do not owe the money.

Also, send it certified with a signature required so you have proof someone signed for it,

call and hire a lawyer immediately..maybe get pro bono services from local legal aid , in the mean time, tell whoever is calling you that they are harrassing you, that you have hired an attorney and that if they do not halt all actions against you immediately then you will sue them for harrassment and fraud. Take down the time, date and who you talked to and what was said..keep all notes and corespondence. your lawyer will want these.
