I tried once to file a dispute with Paypay for an eBay item, but they put you through a lot of red tape, and there's really no guarantee they can help you get your money back. If you paid
for the item with a credit card, you cabn file a dispute with them.
But if you paid by cash, check or money order, you (could have) cancelled them. But at this point, I don't know what to tell you.

Yes you should get your money back on an illegitimate transaction. It will probally take a while, but since paypal uses visa and mastercard the rules for fraud are the same as if you used the card directly, as long as you took the money from your acct or your credit card.
You might want to get with your bank also and report the fraud, they might be able to get you some assistance also.

Depends on how you've paid for it... if you paid it with a credit card through paypal, they won't do squat. If you did a bank transfer they'll refund your money IF the seller agrees it never got sent.
I do a lot of ebay, and I learned the hard way to ALWAYS pay with a credit card. At least if the seller stiffs you the cc company with suspend the payment and do a refund for you.
