If I have several kids and some have been major screw ups and have cost me a lot of money while others have never asked for a dime, how do I fairly give out the money and property?

Are you talking about writing your will or is this something you've inherited?

I'd take into consideration the amount of money that you've had to spend (outside of normal raising children costs, college, etc), when deciding who gets what. Especially if you've had conversation with them about it. But if it's your will you're talking about, make sure it's locked in tight with no loopholes. You don't want your kids going to court to battle of what you've left them.

How you divide your money/property is completely up to you. There are no rules. I suggest giving most of your money to the better children. Anything you give to the screw-ups should be put in a trust and doled out in small increments, so they don't burn through it right away. Specify in your will exactly why you have made the decisions you have.

Definately consult an attorney. Laws are different in every state. In some, if you don't leave at least $1.00 to each legitimate child, that child can hold up the inheritance until they resolve whether or not they were left out intentionally or not.

My thoughts are - give your children what they are going to get while you are still living, and spend the rest on yourself.

You talk to an attorney; every state's laws are different, and in some states you can disinherit a child because of parental neglect or abuse ( that is, the child abuses the parents or neglects their needs). Other states you need no reason, but you have to make a will.

I know I'd give more to the ones that were nice to me. Besides, family feuds after one's death is always fun to watch.
