My husband has a 7 yr old son from his previous relationship... for the past year he's been seeing him on and off, only when the little boy calls him to pick him up...Today my husband got a phone call Im thinking like from CPS that his ex is accused of abuse to that boy and another 13 yr old girl she has... my husband is mad but doesnt know what to do...he wants to get custody but we dont know how to go about it... Will he need a lawyer or can a judge just taker custody away from her.. how much does this cost and how long is the process....will we be able to get the boy or knowing this, will she try to get her son back?? What are the chances of her getting them back? Help!

If you can afford a lawyer I would certainly get one... it will take some of the stress away because the lawyer will know exactly what needs to be done. I would definitely have your husband contact CPS and tell them he would like to help and explain the situation. The people there are trying to help the child and want to get him to the best situation possible. Ultimately it seems it will be up to the judge -- with advice from the state lawyer and cps case worker. But I would really think about getting a lawyer and doing it right the first time.

If you can prove abuse, or if the 13 year will testify against her then you have a good shot at getting custody. You would need to consult an attorney for the procedure in your state. (It also wouldn't be a bad idea to show that you have a steady income and a loving family to live with.)
