Is this really a law?
Our landlord says that if there are 2 adults and a baby over 6 months of age, that we will be forced to rent a larger apartment.
She said that it is the apartment's policy and that she is almost certain that it is a law in Overland Park, KS. When I talked to someone else about it, they said that it IS a law.
(BUT there are 5 adults and 2 kids living in the 1brm next door!!!)

In addition to this, she gave us the option of just paying month to month for the next 3 months while we decide what to do. We presently pay 700 per month, but would have to pay 800 per month if we went month to month. Is this reasonable?

Ya know, the look and feel of kansas info on tenants is so hostile to tenants it's shocking. It's a very stark contrast wtih California and NY's which have lots of info and respect for people.

You certainly don't need a bigger bedroom. Babies evolved - hey, good one for kansas - to need to sleep with their moms, so can Kansas really compel you to have a room no one in your family can use without compromising your baby's welfare? jeepers.... sounds like a legal issue to me... hope you're nursing - co-sleeping aides nursing which is vital to brain development, diabetes and cancer prevention, and emotional well being.

Its the law for public housing. I don't know if private housing gets to set their own rules or what. Probably they are allowed to enforce the same standards if they choose to. You could report those other people if you wanted. I think you have like 3 months rent free if she evicts you though and if she is already using the E word I would milk it for all its worth because she isn't being very nice about it. An eviction looks just as bad whether you stay the full time without paying rent or leave right away so don't be in a hurry to leave if they through you out for that.
