my 1st grader needs help in school he had Special Ed in Kindergarten but his school does not offer it for 1st grade why i don't know he has been diagnosed with ADHD, he did great in K but failing in 1st grade i try to help him all that i can what else can i do?

There are special education services from birth (early intervention) to high school graduation (Individual Education Plan). The school might be based on an inclusive or mainstream model, but there has to be supports in place for identified disabled students under federal law. At minimum, there should be at least a Section 504 document which provides classroom modifications that allows him to attend school.

Was your son on either an IEP or a 504 while in preschool? If so, these can not be suspended without the permission of the parent and/or the school. IEP's are written and stand for a three year span. Unless the IEP expired and the school "forgot" to tell you it was time to re-new, there is no way they can refuse to provide services mandated in the IEP, no matter what the grade level. If you know for a fact the school is in violation of the IEP, immediately contact the special ed advisor for your son's school district, as well as the administration for the school. Demand that action be taken immediately or you will begin legal proceedings and do not back down! Keep a log of all communications, including date, time and the specific person you have spoken to.

If your child is clearly struggling, then as a parent you can request the testing that will start the wheels towards getting an IEP (individualized education plan) in place. Once the process has started, testing must be completed in 90 days (consecutive days, not school or business days..don't let them tell you otherwise) and a meeting with the testing personel, the school rep, the classroom teacher and the parent must be held within a few weeks. At tha t point, results are gone over and decisions will be made.

Until then, keep a log of all the issues your son is having. Communicate daily with the teacher (a notebook in the backpack is a super way to do so) and find out where he/she feels your son needs help the most. Find out what services your school and school system have to offer your son. When it is time for the meeting with the school, you may bring in anyone you feel can be of assistance...parent advocate, other parents who may have more experience, a peditrician or even your own test results. Also, I always tape record any meetings I have and encourage all parents to do so as well, You will need to notify the school of your intent to record at least 3 days prior to the meeting so they can have a recorder of their own present as well. Go in informed...know your options.

Hmmmm I do believe it is very illegal to NOT offer Special Education Services to EVERY grade level in a public school.

Check out "the NO child left behind act" and WHOSE IDEA is this.
Both of these explain YOUR CHILD's RIGHT to an education.

If your child has an Individialized Education Plan (IEP) from Kindergarten, there should have been one in place for first grade. I do believe I would talk to the Guidance Counselor or Administrators for your school system because not giving a child the special education services is VERY ILLEGAL.

They should offer it to all grades...you can take the school district to court under two Federal laws - the Education of All Handicapped Children Act (1975) and the Individuals with Disabilities Education Act (1997) and have a Judge order them to give your child the special education services he is entitled to.

If this is a public school... they MUST offer special ed... if you are not in a public school.... transfer so your child can get the help he needs and deserves.

type a letter to the school counselor. say i would like for my child be tested . ASAP. Make copies one for the counselor, principle, child file, school district.. I guarantee they will get your child tested. get to know the staff. your child teacher.

ADHD is a LOAD of B.S. used to feed drug companies more money from concerned parents.
