a mom has fled out of state to her own mother's house when her fiancee told her he wanted her to leave by end of month. Mother lives in another state. The child' father( the ex-fiancee) has already, (after just 10 days) had papers drawn up &served- sueing for custody of the baby. now the mom has to respond to the summons in writting within 10 days .She has no money what are her options?????

She needs to check the order adjudicating this man the father of the baby--she can find that at the child support agency in the county where paternity was established. Most cases (depending on state) will have standard language in regards to custody and placement of the non martial child. If this was not addressed, she needs to go to the local child support agency where she is at (with a copy of the paternity judgment in hand) and get advice from there. Most likely there is something mentioned in her paternity papers. If paternity was never legally established, HE is out of luck until it is.

she can go pro se, meaning without an attorney, yet most judges hate dealing with pro se's as they are time-comsuming. She could hire an attorney with what little money she does have, file an answer and a counter-petition. If this was one of our clients, we would request Interim Attorney's Fees. Although, that does not necessarily mean the judge will grant it. As long as she files an answer, she has the right to be notified of any proceedings that are going on. If she doesn't show up at the hearing and file an answer, she can make default. Basically, the proceedings can go on without her and the judge may even order her to return the child(ren) to the other parent/

Go to child services in the state she is living.
