We have a child together. hes made it clear he's gonna fight me for her. He has a history of assualt and getting physical with me. never her. Im not going to contest it. The divorce is the easy part it's the custody issue thats going to be kinda crazy. I've had her for almost 6 months.

You don't have to have a lawyer to get a divorce, it is just in your best interest. As a part of your settlement, you can ask that because of your circumstances that he pay for your attorney. You might get an order for this from the court, you might not, depending on your circumstances. If you don't own any property together and aren't fighting over the division of property and if you don't have children, there really isn't a need for an attorney when filing Irreconcilable Differences.

If you don't have kids you really don't need a lawyer to get a divorce...If you guys can agree on the split and everything - I don't think you need one at all. The lawyer doesn't do anything but try to get the two of you to agree on a settlement and you can do that on your own if you are able to talk to one another. I got divorced but had no kids - I had a lawyer but it was not worth it. He did absolutely nothing for me. I live in a no-fault divorce state and there was nothing that could be done on my account. It depends on some variables... If he is filing for the divorse he would pay most of the fees and you might not have to pay anything. Good luck.

No, but you may qualify for legal aid. Considering that California has communal property laws, that may be why he filed in Texas. I assume he makes more money than you but there must be shared assets. Do yourself a favour and hire a good lawyer.

You need documentation on all the joint marital assets you both have. Since Texas doesn't have communal property laws, you will need a strong argument based on contributions, financial and emotional and time, as well as financial need. Try asking for alimony instead of splitting the property, unless you stand to get a better settlement that way. If you have a history or he has a history that affects character, it may come up in court. I hope your ex-husband isn't the sleazy type.

You don't have to have a lawyer to get a divorce. If you want stuff or money and he doesn't want to give it to you, then you may need to hire a lawyer and of course you would have to pay for it. If you don't need anything from him or don't care just let him file. He'll pay all the fees and you don't have to do anything but sign the papers he mails you.

You only need a lawyer if you plan to contest the divorce or the terms of the divorce.

If you do plan to contest it, you'll have to pay for your own lawyer.

My friend had a similar situation and had to pay his own expense to fly to the state where the divorce was filed and he acted as his own attorney because he couldn't afford one. He lost the farm. I feel for you. Best wishes.
