me and the father were never married. he pays no support. and i don't want to get in trouble for taking them out of state. i've heard that i can and i've heard that i can't.

As long as there are no legal papers saying who has custody and who doesn't then yes you can. You can't get into trouble they are your children. Funny that people would say that you can get in trouble, unless we don't have all the facts.

Well, if it has been legally determined that he is the father, then you can't unless you notify him. And even then he can charge you with kidnapping. The only way you can take the kids out of state is if you have full custody or at least primary custody. Even then you will have to notify him (at least 30 days) and the appointed court. Get legal advice before you leave.

i assume you live in the states and i dont know the law there
but in Europe the law basically is you have to have permission to take the kids out of the court juristiction ,that is written permission from the father which is required ,but only if his name is on the birth certificate and he pays maintainance.
if he doesn't then you should be ok as you are the parent resposible.
check with your lawyer to be sure.

I might be wrong, but until that hearing I don't think you can unless you get the permission of the father (husband or not). I would check with a family lawyer before planning any trips though.

talk to the judge i know no mater where you live he still has to be able to get visits an if its you moven away your reliable to get them to there dad or it could be you in trouble good luck
