Is it legal for an employer to withhold wages once they catch the fact that they have over paid months before?

Yes, it is legal for them to withhold the overpaid wages. Most companies will work with you if you talk to the payroll department. If it is a substantial amount, a lot of times they will break it into smaller payments for you. They can't expect you to live on nothing.

Yes it is. They do not have to "notify" you because you were well aware when the overpayment occured.
