Usually, these matters are settled in court, but in my opinion....if she wants to live in the house, why should he pay for her mortgage? Being there is a child involved....maybe they can come to some sort of agreement in which they both pay half. If the house is paid for...why don't they just sell it...split money and she get smaller place that she CAN afford?

She should get an lawyer to find out what her legal rights are. She may have a few months tops to continue to live there if her name is not on the mortgage. If he walked out on her, I'd make damn sure he pays something, take him to court for abandonment, child support, something. I wish you the best of luck.

He should half to pay for the mortgage or at least half of the payment plus he will half to pay child support, but if she was to get remarried or has a man move in with her it will be changed she will half to sell out or take on full responsibility of the house payment that is my experience in this...hopefully everything works out for your sister and her four year old..May the lord hold them in his hands threw such a rough time in their life

If she is on the loan, then she could be responsible for paying the mortgage also. If she isn't working, the full responsibility would be with her husband.

whom ever is the mortgage deed to or got he mortgage whos name is the house in there is no marital home but a mortgage holder and if not paid there it goes into foreclosure

yes. if she says she wants to live there. but they could sell it and take half. The judge will probebly award the house to her which is what happend to me but i struggled to pay the mortgage myself for the first 2 yrs but i made it.

This is where the laws piss me off. I believe it should depend on who wants the divorce and why. If she wants out just because, then she should have to pay. If she wants out because he is abusing her in any way he should have to pay, and vis-versa.

Depends who's name is on the mortage. If they both are then they are both responsable for paying the mortage, if its just him then she doesn't have to pay it, although he can kick her out.
