Probably because not all "out of date software" is free. The fact that its old and/or not sold anymore doesn't mean anything.

wow good theory, so when software is a few years old it becomes free
hmmm try again when something is old is not free!! it is replaced by a newer version or not replaced at all your still not entitled to it for free.
but saying all of that in the current climate music, films, games are all available to steal on p2p so why not
