I got a questions for those who know canadian law.
I was wondering if I get divorce what will happen..
1, what is chance for mother, me to able to keep baby? noneof us cheated or anything...
2,what can i do to start to gain possibility to get right to keep baby?
3,am i allowed to moved out province to live?
4,what will happen to our debt, like visa, line of credit, lease for car..what about our own debt from before married like his student loan...
i'd appreciate if you could give me some tips. also is any good counseler for kids to go during divorce?? thanx

sorry i forget to mention that some debt like visa and line of credit are under both name. whats going to happen if we own house??

Well in Canada as a mother you automatically have rights... that's it of course if you are not a drug addict.. alcoholic, gambler, etc.... as for your bills, if it was under your name alone.. well it becomes your problem, if you don't pay them they will come after you, you can always claim bankruptcy but it doesn't look good on your records... about moving out of the province, that i am not sure, speak to a lawyer

Usually in Canada, the mother gets custody of a baby, but sometimes it is shared depending if there are any violence problems . If it is shared usually you have to stay in the same province but that is up to a judge. As for debt, if your name is on it as well as his then you will have to split the bill. Your own debts before the marriage will be yours to pay. As for a child councillor ask your doctor or a family councillor or even go through mental health group.

debt is usually divided the same way assets are, custody issues depend on who can provide the children with the best life (emotionally as well as financially) there is also interim custody,judges don't like to take kids from the caregiver responsible for them now.And finally yes you can move if you choose but make careful consideration if joint custody is an option or even if you would like the other parent to assume some care-giving and support to the kids.their are government websites that can give details in your province.

You will end up with the baby and he will have to pay support.thier are two ways to settle debt and assests one is amecably through a mediator. or two a the courts look through everthing and makes a decision for you. Always comes in favour of the one with the child. you can go to the family court anytime and get free advice from a lawyer. that is what i did they help you let you know what could happen to you and let you know where to go for help

as far as i know regarding the children the mother always gets custody unless she is proven unfit to care for the kids
