My daughter is 13 years old and living with her aunt and she is the payee for my daughter's benefits. My question is, how much of her ssi should go to paying her aunts bills such as rent, elect., etc., etc. ? When the aunt is living under government housing and is receiving foodstamps. She too is receiving benefits along with her children. She says my daughter has to pay for her portion of all her bills which would leave my daughter with nothing for herself. Not sure if this is fair. Or could I change payee?

The first question I would ask is how severe is her disability that she gets a check? I have worked with people when I used to work for the state that received SSI and most times when there is a payee designated they are supposed to keep records and receipts for everything the money is spent on...as it is only intended as a supplemental income. Also, most times there is a payee designated, the person for whom the benefits are paid are forbidden from free access of their money and it is too be used to pay for their food, shelter, clothing, and what is left over can be used for amusement and other necessities. If the aunt is the legal guardian, she would most likely be required to request a change for the payee unless you can prove the money is being used for other things that don't benefit your daughter..check with your local welfare agency or social security office for more information.

Does welfare know that the aunt is receiving this extra income?If she is keeping that a secret from the government she could be in a mess of trouble.
As a payee your aunt will have to report to SS every year how she spent the money that she received for your child.They send you a form every year and if you don't fill it out,the benefits are cut.They also want to know how much was saved in a bank account for the child.

Im not sure her aunt is even qualified to be anyone's payee because if she's on assistance, her benefits may be reduced or she could get cut off completely; that is if she's telling them what she's doing. And I think your daughter should get a certain portion of her own check for herself even if it needs to be saved for her.

I think you should find another payee for your daughter. Someone who would take only whats fair.

first off why isnt your daughter with you instead of the aunt and 2nd I hope she has reason for getting SSI at such a young age

as for your problem I'd say its totally illegal for the aunt to be taking anything from the young girl or her own kids to pay her bills the government takes into account the costs when they issue the checks to people she's getting as much as she needs to herself she shouldn't be taking anything from the kids at all

Well as long as your daughter has clothes, food and shelter, her aunt can do whatever she wants with the money. The money is for providing those basic needs not for having some extra cash in her pocket. According to the government your daughter is a minor and as long as she is getting those basic needs and medical attention, the aunt has control of the money.

If your daughter is living with someone else, there is obviously other issues going on with you all. If she is better off there, love her enough to let her flourish. Benefits are to be used for living expenses. If you truly feel that she is being taken advantage of, call social security and tell them, but be prepared for a tidal wive of destruction formed by the storm that is anger.
