Anything that is used in a situation to inflict fatal harm. Your hands can be considered a deadly weapon if your intent in using them is to beat someone to death. Legally speaking, a car can be a deadly weapon if you use it to run someone down. A heavy vase can be a deadly weapon if you strike someone on the head with it. The intent must be or could be fatal harm, which does not necessarily mean a death has to occur. That could also mean anything with the potential to inflict such harm, something that in most liklihood when used is used with the knowledge that it can kill, such as a gun, even if you use it to warn someone else or just to incapacitate someone, and the killing is an accident, it is a deadly weapon.

Here is a deadly weapon - take a newspaper, roll it up tightly so that is resembles a stick. Poke this stick straight into a person's neck and it will kill them. Unroll your newspaper and read it as you walk on down the street. You will never get caught.

It's not restricted to guns and knives...anything that can be used by a person to kill another person....could just as well be a club, a two by four, a chainsaw, a tire iron or a frozen leg of lamb.
