Either way, you were still speeding. You can go to court and find out if you can attend traffic school to erase it. I just finished traffic school for the third time!! haha!! Mailing my certificate to the court tomorrow....unfortunately you will still have to pay a fine, but its well worth it to not have it on your record.

It's not a pleasant position to be in - something similar happened to me yesterday but luckily there were no police around.
