no they cant be prosecuted at all. even if you were talking to younger girls or boys, unless you have initiated inapproporiate things with a minor, then they cant do a thing to you. (and thats if they catch you in an inappropriate conversation with them). now, some person mentioned identity theft, its not identity theft because most just make up a random name thats not a real person, and they are not using it to buy things or get things.

I would say no, unless they use it to commit fraud or cause harm to someone.
For example, if they put on a lot of doctored photos and made it sound like this person was very 'easy'. And, as a result, the person got a lot of email from people looking for sex or if it otherwise affected their life (like the boss sees the email and they might lose their job). In this case, she might be able to get charges or bring a civil suit against the person who created the fake site, and perhaps against MySpace. I know there have been cases like this with people posting their enemies names/profiles on dating or swingers sites.
At the very least, they should contact MySpace as ask for the site to be removed or blocked.

I don't know the answer to that question, to be honest, but I would sincerely doubt that anyone would ever follow through with prosecuting someone for such a thing. The money it'd take just to sue the person would be ridiculous.
