Its Alienation of Affections, the law has been abolished in Texas, and nearly all of the states in the USA.

One used to be able to sue for "alienation of affection" but I do not know if that is true anymore. In Texas Bush changed the laws about suing alot so you may have to check that with a lawyer.

Historically, there had been a tort (civil cause of action) called alienation of affections. However, the marriage has to fail (divorce or abandonment) in order for the hurt spouse to have a case. However, almost all states (including Texas) have done away with the statutes creating the cause of action.

Well it would seem he never really wanted you as a spouse and the marriage has not met his needs - he married because dad made him. Now you must decide if what you get from the marriage money etc is worth putting up with his actions if not then the marriage must end - you simply do not have many options. Why women have unprotected sex with men they are not married to I will never know

Your are referring to a lawsuit for "alienation of affection". Nearly every state has gotten rid of this type of lawsuit. In 1997, Texas enacted Family Code, Chapter 1.107 to abolish the right to bring an alienation of affection lawsuit.

Why sue the woman? It is the husband that broke the vows. The wife has no contractual agreement with the mistress.
Sue the husband for divorce.

Hiya. Not sure if this link will be useful to you at all. I did a search on an FAQ website... there was one woman who asked the same question, but she's in NC

What you after her for, didn't see him in the pic? Oh, it was her fault he cheated, get real, leave her alone, direct the hate towards the cheating husband. Most of the time a man comes up with a pretty good reason for playing. Wife got sloppy, quit putting out, had become a full time *****, hum???

In all reality why would you want to sue her? Its his fault more then hers, he knew he was married and could have stopped it. More then likely if you did sue you would get nothing out of it anyway
