I would recommend getting a patent.

There are two types to consider in your case:

1. Design
2. Utility

Utility covers the basic usage of an invention (e.g., safety device).

Design covers the significant design of the invention (more straps, braces, etc).

It is usually easier to get a design patent than a utility patent.

I would recommend going to the US Pat and Trademark Office site at www.uspto.gov and do a search for something like what u wanna patent. Do a design and utility patent search.

You could hire a Pat atty, but it is not required.

They specialize in knowing what to look for in the search and could save u time in an extensive search...and may end up with the same findings as you if u did it yourself.

If conducting a self search be prepared for spending hours looking online for items similar to yours. Document competing designs' patent numbers for future reference. You will be asked (probably in the application) if there are similar designs to the one you are submitting with your application.

If after your extensive search and documenting what patents are close to what wanna patent, locate a draftsperson to provide a professional drawing of what you wanna submit for a patent.

While conducting ur patent search, get the patent number(s) of submittals which closely resembles what you want yours to look like Read the applications and research what those submittals are made of. It may referennce that type of fabric, number of stitches per inch, weight constraints...

Have the person who creates your drawing, sign a non-disclosure agreement to further ensure that the work they did is "work-for-hire" rather than a co-inventer of your design.

After u have that in place, consider filing online as a individual rather than a corparation/biz. Rates are significantly cheaper.

Once u file, be expected to wait a loooooooooooong time to get a response from the Patent office. Months...maybe years. They may have a note on the site about potential turn-around time.

In the mean-time, keep your lips ZIPPED until you at least get...if at all, a letter from the Patent Office that your invention is Patent Pending status.

While you are awaiting coorespondence from them, do some research for mfgs who will be able to manufacture your item. I would wait until you at least get Pat Pend status before you spend $$ for any type of prototype.

I know you are itchin' to tell the world about the "original" thought you came up with...but be patient. K?

:-)

Been there...done that...

:-)

Look at similar items as your proposed invention and see who mfgs them. Compile your list and find a marketing firm who has marketed safety devices. So, when you get the green-light from the Pat office...you're ready to go!

Lastly, there could be additional uses for your design which you may not be aware of.

Mountain climbing...construction...the list goes on.

Feel free to email me and we can bounce some ideas off of each other.

Who knows, you may be the next Thomas Edison!

Best wishes.

See a patent attorney first, then market it.

Now that you have pretty much described the whole thing...I could patent YOUR idea tonight, and sue you if you try to sell it.

Pretty twisted, huh? That's the way of the world.

ps: don't worry, I'm not actually going to do that...I wish you luck.

pps: My great-great-grandfather was the inventor a chemical sprayer for orchards...he went door to door with his contraption until he found somebody that would manufacture it, and then he became very very rich (through lots of hard work of course).

there are countless traders that can assist you you in direction of the technique, yet on the tip of the technique, they get a super shrink of the money you're making. you may desire to be careful, at first, you may desire to get it patented, there are 2 varieties of patents, the 300 and sixty 5 days patent meaning your product is patented for under a 300 and sixty 5 days, and the genuine patent, which expenses a pair thousand funds, yet insures your patent for lifetimes. once you get your concept patented, assuming you have achieved a patent seek, you detect a fashion designer to do CAD designs and that they'd positioned your product into action, after that, you're taking your product to available shoppers and voila!

look for backers, like angel investors, get a patent, and build a prototype.
