If a wireless network is not password protected (in other words it's an "open" network), then you can use it. It is the owners responsibility to protect their network if they do not want others to use it for free.

You're safe to use the network.

It's not really stealing if it isn't password protected. If it isn't pasword protected it means that the person who set it up either doesn't know how to set up a password or doesn't care. I have no password set up on my wireless internet and thats because i dont really care. Some people do care but do not know how to do much on the network connections. That i know of you cannot get in trouble for using it.

It is Stealing, But I don't think It would go as far as arresting, most likely if they find out the will just change their settings or confront you. At worst maybe a fine.

It is a 3rd degree FELONY in Florida!!!

What happens when stupid lawmakers get into technology that they are incapable of comprehending...

LAWYERS, AGHGHAGHAGHAGHAGH!!!!!

But, as long as you aren't parked out front in your car, like the dude arrested here was... hard to catch you... and, some of us share on purpose. The RIAA doesn't want to open up THAT bag of worms in their lawsuits against uploading some music files!

They have an option to encrypt the connection, so by leaving it open they are inviting you to use it.
