My 8 year old son was choked at school by his teacher. I went to the board and to the principal and still nothing has happened. I am very furious. I am also upset that the principals and the school board do not believe me nor my child. I also have statements from 4 other kids that stated they watched this teacher choke my child. Now I am trying to keep it civilized with these people but they are working my nerves up. Is there any legal advice that someone can share with me. I am a single parent and I am very concerned. I have had other parents step up and admit that this teacher has hit and pinched their kids. So, I am just trying to get some other opinions on the situation. My child is afraid to go to this lady classroom, because he thinks she is going to put her hands on him again.

when someone chokes your child, it is out of the jurisdiction of the school. why haven't you pressed charges against this person? pull him out of school - enroll him in another. get signed affidavits from the other parents. and get a lawyer - this case could get them lots of press so may do it pro-bono.

First, if this is the case, why is your child still enrolled in this school or at least in this teachers classroom? Second, skip the principal and go to the superintendent. Third, if your local TV stations do any investigations, go to them. This is a hard situation, as someone said above, children can say anything and they are believed. I work in a school, and a boy told his teacher that he was going to tell his parents that the teacher punched him, then have his parents beat her up and get her fired. This was a child in second grade. I am not saying your child is lying, because you have proof from other people as well. I say, do what it takes until you are heard. If need be, go to the local paper, but I say keeping your child at the school, would not look so good.

First thing I would have done is call the police. Have names of other parents to give to the police. See a lawyer as a group to get the teacher fired. Did you take pictures of bruises? No teacher should ever touch a student in this day and age. I would never send the child to that school again.

If the school officials are not interested in helping you then you can:
Put up flyers in the area.
Take out ads in local newspapers.
Sue the school for child endangerment and child abuse.

If your (teenage) child choked a teacher, I bet they would all sing a different tune!

Have you talked to a local newspaper or news station about this? Once the school and school board hears that on the radio they should get serious and start moving with it. If not talk to a lawyer, and hire one that you think will fight through the case and that you can actually deal with. If you can't afford one, I'm sure there's one out there that would love the exposure of handling this kind of case. They will take this case more "high-profile" by spreading the news to the local media. It's sad that that's what you'll probably have to do to get things done, but that's how it is nowadays. If your child is afraid to be in that classroom, dont send him back to that school. Enroll him into a new school so he isnt truant. You can also start a lawsuit if you want. You have statements which is good enough. And other parents who also had their kids abused by the teacher, you have a good case, I think.
In this century it isnt acceptable for teachers to abuse the kids.
Remember in the 1980's, teachers could do what they wanted, breaking yard sticks on our heads, piercing our ears with their nails, swearing at us. Yeah, us generation X people had it rough, and now we want to protect our kids from the same abuse. Good Luck.

I would file an assault complaint against the teacher, then I would notify the state Dept of Education and file a complaint against the teacher, school and the district. Then I would get a lawyer and file a lawsuit. (After that I cannot tell you what I would do, but someone other than my child would be choking.)

maybe you could report it to the police. If the other parents report their incidents to the police the teacher may be arrested. That takes it out of the hands of the school who don't seem to care.

Did u file a police report. SOmething has to be done. That teacher is breaking the law.

Go to the school board again and tell them you will take legal action against them. Talk to a lawyer, most consults are free.
