no.. to respectfully dispose of a used and tattered flag the prescribed way has always been to burn it.

Section 8k of the Flag Code states, "The flag, when it is in such condition that it is no longer a fitting emblem for display, should be destroyed in a dignified way, preferably by burning." We recommend that you contact your local VFW Chapter and ask them for help properly disposing of your flag. And be sure to consider providing a small donation to them for their assistance. Or you can contact your local Elks Lodge (who created the idea of Flag Day, established officially by President Truman, himself a member of the Elks), the American Legion, or the Knights of Columbus. Some Boy Scout and Girl Scout troups also can provide this service.

No. In some cases it is actually the correct procedure to do so! If the flag become, ragged, faded you burn it while being respecful. You might be interested in the ettiquite for dealing with the flag:

The flag should be lighted at all times, either by sunlight or by an appropriate light source. (So the flags you seen flown at night unless lit by spotlights are in poor taste).
The flag should be flown in fair weather, unless the flag is designed for inclement weather use. (The flag is never flow when the wind speed exceeds 10 miles a hour).
The flag should never be dipped to any person or thing. It is flown upside down only as a distress signal.
The flag should not be used for any decoration in general. Bunting of blue, white and red stripes is available for these purposes. The blue stripe of the bunting should be on the top.
The flag should never be used for any advertising purpose. It should not be embroidered, printed or otherwise impressed on such articles as cushions, handkerchiefs, napkins, boxes, or anything intended to be discarded after temporary use. Advertising signs should not be attached to the staff or halyard.
The flag should not be used as part of a costume or athletic uniform, except that a flag patch may be used on the uniform of military personnel, fireman, policeman and members of patriotic organizations.
The flag should never have any mark, insignia, letter, word, number, figure, or drawing of any kind placed on it, or attached to it.
The flag should never be used for receiving, holding, carrying, or delivering anything.
When the flag is lowered, no part of it should touch the ground or any other object; it should be received by waiting hands and arms. To store the flag it should be folded neatly and ceremoniously.
The flag should be cleaned and mended when necessary.
When a flag is so worn it is no longer fit to serve as a symbol of our country, it should be destroyed by burning in a dignified manner.


I personaly do that with anyones flag! During the Civil War the Color Guards (Carried and protected the respective flags) besides trying to kill one another got into fist fight, but they never allowed the enemies flag to be handled disrespectfully. Not as such, though it is illegal to burn anything in most places and under most circumstances, because of the fire hazard. Under conditions that do not cause a hazard to public safety, burning flags of this or any other country is a form of symbolic speech that is clearly protected by the First Amendment.

At the present time there is no restriction.. there is discussion in congress to create a desecration law concerning the flag Very few people understand how the burning of a flag has anything to do with the "freedom to speak" is not the freedom of speech.. Look it up. That distortion was implied by te courts.

No, it is still considered freedom of speech. Some people don't like that though and want to change it.

It is also appropriate to ceremoniously burn old US flags rather than just throwing them out. The ashes from the flag are suppose to be buried as well...not thrown out.

I think it might be to burn american flags because it is our own country. Gust in case don't burn a american flag.

no, but it is very disrespectful do veteran like me and my friends. the should only be burned if it becomes too tattered and soiled to fly with pride, then it is burned with honor. i fought for our freedoms even to burn a flag, but that does not mean i wont kick the *** of someone i see disrespecting my flag.
