i let my kids move in with thier dad 2 yrs ago...im just finding out now that he is getting drunk daily and that there is daily fighting between him and his girlfriend....they dont want to go back to his house and they have asked me to go to court to get them back...they are scared to go back because their father is going to find out soon that i have filed to get them back...and he is going to be livid with them and they are scared......is there anything i can do to get them out of their dads house immediately? please help

wel one thing you can do is if you know he is drunk and the kids are there the police can be called...you can also contact your local department of social services. i would go to the family court and ask for a temporary order immediately and explain the situation to the judge...

If you and he are not divorced go straight to a lawyer in the morning and file for divorce and custody for the kids. U have to be the first to file though because if he files first then there is nothing u can do. If the kids are all over the age of 12 and up they don't have to go back just get a lawyer and they can tell him themselves whats going on and why they don't won't to live there. good luck

yes altho you didnt say there age. the attorny can get them in to talk to the judge and them rule a decision wheather this is true are the kids are being program to lie. cps should have been called so there was a record of this. were there events when the police was called. on he and the gf, neighbors friends witness this behavior this might not be a factor when they ask the girls seperated times and they both tell of the same events no child should have live like this the kids will become nervous wrecks my prays goes out to you and the kids TRUST GOD and he will do whats right

You hvae to get them out of that house immediatlly for thier sake....If you didn't make the custody change legal in the courts then you have the right to take them back.If you did, then you have to present proof to the court that this is going on in that household.....That where you will have your work cut out for you.....Contact a lawyer and get legal advice on this....It very important you do this tomorrow....Good luck

if i knew what state you were in.... in mine if a parent puts a child in that type of home then it is endangerment and child abuse you can just call the cops tell about the drinking and fighting and that the kids are at your house they come out and ask the kids they stay with you and the ex goes to jail then you go to court he has child endangerment case pending you get custody end of story
